CyberCube Disclaimer and Assumption of Risk Statement

The declarant (hereinafter referred to as "I") hereby state that I am of legal age, or that I am the legal guardian or custodian of the participant, and that I have carefully read and understood the following terms and conditions, and agree to comply with them:

1. I understand that "CyberCube" (hereinafter referred to as "the Activity") is a brand owned by "CyberCube Co., Ltd.", and is operated and managed by "CyberCube" (hereinafter referred to as "the Operator").

2. I and the participant have carefully read and understood the "CyberCube Game Experience Venue Safety Instructions" before participating in the Activity, and agree to comply with them.

3. I understand that the Activity is a sports event, with inherent potential risks associated with physical activity, and that unforeseen accidents may occur. All persons participate the Activity on-site, including myself, participants, or third parties, are at risk of injury (including but not limited to: sprains, bruises, contusions, etc.), illness, or property damage due to their own or third parties' actions.

4. I and the participant have independently and fully assessed our own and the participant's own abilities and risks. I have not concealed any existing physical or mental health problems. In this case, I and the participant both understand and voluntarily accept and fully assume all known or unknown risks, and I am willing to waive and release any and all claims or liability of any kind against the Operator and its employees. If I cause any damage to others, I am willing to assume liability for such damages. The Operator is not responsible for such damages.

5. I and the participants agree that if any personal, physical, or mental injury, economic loss, or other harm is incurred due to the negligence or actions of other persons using the facilities or of the Operator, the Operator may assign this liability to the professional insurance company the Operator cooperates with.

6. During the Activity, participants are prohibited from engaging in any form of dangerous activities or games. If a participant violates the usage rules and safety instructions or fails to follow the instructions of the Operator's staff on site, the participant and I both understand that the Operator have the right to immediately stop the participant from continuing to participate in the Activity and request the participant to leave. If any participation fees have been collected, they will not be refunded. The participant and I have no objections.

7. The participant and I understand that any damages caused by accidents or failure to follow the Operator's instructions will be borne by the participant and I.

8. The participant and I agree to indemnify the Operator for any expenses incurred as a result of any liability, claims, losses, obligations, costs, or damages. The participant and I also agree not to file any legal claims, lawsuits, or demands against the operators as a result of participating in this event. Otherwise, if this leads to the Operator having to take legal action, the participant and I agree to unconditionally pay all expenses incurred by the Operator as a result (including but not limited to: the costs incurred for executing or fulfilling this statement, litigation costs, attorney fees, and costs related to collection work). The participant and I have no objections.

9. The undersigned and all participants acknowledge and agree that, for necessary purposes including venue safety management, incident handling, dispute clarification, and protection of rights and interests, the operator may, during the activity period, conduct and retain photography, videography, or other activity records within a reasonable scope.

The foregoing materials shall be used solely for the purposes stated above and shall not be used for advertising, marketing, or any other commercial purposes. Where any further use is deemed necessary, the operator shall obtain the prior consent of the undersigned and the relevant participants.

Any photography, videography, uploading, sharing, or similar acts carried out independently by other participants at the venue or by third parties shall constitute such individuals' personal acts. Should such acts involve the portrait rights, privacy rights, or any other personality rights of others, the actor shall be solely responsible for any such acts. Such acts are not conducted under the operator's instruction, authorization, or control.

To the extent permitted by applicable law, the operator shall have no obligation to conduct prior review or monitoring. However, upon receipt of a reasonable notice from the right holder, the operator will take necessary assistance measures.

10. In the event of any inconsistency or discrepancy between the English version and the Chinese version of any provision of this Statement, the Chinese version shall prevail.

11. If any litigation arises from participation in the Activity or this statement, the participant agrees to the jurisdiction of the Taiwan Taipei District Court.
